Decd that the Said Jno D. Senr died in the year 186 that prior to his death he executed his last will & testament dated June the 9th 1864 ???? Jno D Carnes jr. his executor and directed said Executor to divide his real Estate equally between his Heirs at law according to quality and quantity & your petitioners further represent that all the debts against the said estate are all paid and that they belive that it would not be best that the land not specially bequeathed in Said Will by Said Jno D Senr Decd be equally divided between his heirs at law Being 5 parcels or tracts of land (towit) The House tract containing 152 acres.
